A student who receives a Reprimand and Warning or Disciplinary Probation and does not accept the outcome of the judicial conference may request a review of the case in a written appeal.
- If the student disagrees with the Dean of Students’ determination of responsibility for misconduct or believes the sanction imposed is inappropriate, they may submit a written appeal. The appeal must be filed with the Office of the Dean of Students no later than seven (7) business days after the date on the decision letter issued following the judicial conference.
- A written appeal and all case documentation will be reviewed by the Dean of Students or their Designee.
- By initiating this request, the student assumes the responsibility of preparing their statement and any supplementary documents to present to the reviewer. As this is a written appeal and not a hearing, only submitted evidence will be reviewed in addition to the case file.
- A student may seek advice from the Student Advocates Office, the IU Student Association Department of Student Rights, or other sources, but the student remains responsible for presenting their case in writing.
- Upon receiving the written appeal, the Dean of Students will set aside the proposed finding and sanction reached at the judicial conference while the case is being reviewed
- Additional evidence may be sent to the Office of the Dean of Students within the seven (7) business day appeal window. Information or a request for an appeal submitted outside of the seven (7) day appeal window will not be accepted.
- The decision being reviewed shall be based solely upon information introduced in the case file and in the written appeal and must be based upon a preponderance of evidence. The reviewing party shall make a recommendation regarding the finding and/or sanction to the Vice Chancellor for Student Life regarding the finding of responsibility and/or the sanction.
- Within seven (7) business days after the conclusion of the review of the recommendation, the Vice Chancellor for Student Life or Designee shall render a written decision. The Vice Chancellor for Student Life or Designee shall furnish copies of the decision to the student and the Office of Student Conduct.
- The Vice Chancellor for Student Life’s decision is final and concludes the process.
